The Facility is a stationary source as that term is defined by section 112(r)(2)(C) of the CAA, 42 USC 7412(r)(2)(C). At the Facility, Respondent uses regulated substances in covered processes at above threshold quantities. On January 18, 2018, the facility was restarting the Melamine Plant and allowed a release of 149 pounds of ammonia to the air. Pursuant to 40 CFR Section 68.69(a), Responded failed to develop and implement written standard operating procedures (SOP) that provide clear instructions for safely conducting activities involved in each covered process consistent with the process safety information.
