Summary

EPA Region III Enters Consent Agreement and Final Order with Blue Ridge Classic Painting, LLC requiring Blue Ridge to Pay $2,378 to settle Violations of Toxic Substances Control Act at target housing: 211-219 W. King Street [Docket No. TSCA-03-2019-0074]. On July 2, 2019, EPA filed a Consent Agreement and Final Order, which initiated and settled EPA's penalty claim for violations of Section 409 of TSCA, 15 U.S.C. 2689., which EPA inspectors documented during a records inspection on January 24, 2018 at Respondent's office in Mount Sydney, Virginia. EPA alleges that Respondent performed renovations without firm certification from EPA in violation of 40 C.F.R. 745.81(a)(2)(ii), and did not ensure that a certified renovator was assigned to the renovations and that the workers were either certified renovators or trained by one in violation of 40 C.F.R. 745.81(a)(3). In addition, Respondent failed to provide the owner of a residential dwelling unit with an EPA-approved lead hazard information pamphlet before beginning renovation activities, as required by 40 C.F.R. 745.84(a)(1), and failed to retain records in accordance with 40 C.F.R. 745.86(a). The RRP Rule was promulgated to ensure that individuals and firms are trained to conduct renovation and repair activities in a safe and proper manner, minimizing lead exposure to the public, occupants of target housing or child-occupied facilities.
