On August 19, 2019, Region executed a Consent Agreement and Final Order (CAFO) with Rick Bedel Construction. The CAFO commences and concludes a proceeding identifying alleged violations of the Toxic Substance Control Act (TSCA), specifically of the Renovation, Repair, and Painting Rule (RRP Rule). Region 5 alleged that in in calendar year 2017, Rick Bedel Construction failed to: ensure that all individuals performing the renovation on behalf of the firm were either certified renovators or have been trained by a certified renovator; assign a certified renovator to each renovation performed by the firm and that the certified renovator discharges all of the certified renovator responsibilities identified in 40 CFR 745.90; and, retain all records necessary to demonstrate compliance with the RRP Rule for a period of three years following completion of renovation activities. Rick Bedel Construction paid a $6,720 penalty.
