The Respondent gained coverage under the Federal Construction General Permit, for disturbing approximately 18 acres of land at The Marketplace at Montehiedra construction site. The Respondent failed to implement and maintain stormwater BMPs including failure to properly stabilize the Site including steep slopes, failure to protect inlets, and failure to properly dewater sediment basin. The Site was also missing numerous inspection records required by the Permit. The penalty has been calculated at $5,000.
