On August 29, 2019, EPA Region 6 issued an Administrative Order (AO) under its authority pursuant to Section 301 of the Clean Water Act, 33 U.S.C. 1311, to the Village of Cuba (Respondent) located in Cuba, New Mexico. The AO was issued in response to the National Pollutant Discharge Elimination System (NPDES) Permit violations which were identified during a review of the NPDES permit file. The violations alleged are for 1) unauthorized discharges during calendar years 2016, 2017, and 2018; 2) failure to submit complete quarterly discharge monitoring reports (DMRs) as required by its NPDES permit; and 3) failure to submit Noncompliance Reports. The AO requires Respondent to take such measures as are necessary to comply with the Permit Conditions within thirty days. Respondent must respond in writing to EPA Region 6 within thirty days of the effective date of the AO.
