On September 3, 2019, EPA issued an administrative order to R.M. Packer Company, Inc. of Tisbury, Massachusetts that addresses noncompliance with Oil Pollution Prevention (OPP) regulations promulgated under Section 311 of the Clean Water Act at its oil storage facility. An EPA inspection revealed that the facility was in noncompliance with Spill Prevention Control and Countermeasure plan and facility response plan requirements of the OPP regulations. The order requires the submission of updated plans and certain corrective actions. EPA is currently in litigation in federal court with R.M. Packer for violations of the Clean Air Act and stormwater requirements of the Clean Water Act, with a trial scheduled for September 23, 2019.
