Summary

On October 2, 2019, a U.S. Magistrate Judge signed an ex parte administrative warrant granting EPA access for one year to a portion of the White Mountain Freezer (former) site in Winchendon, Massachusetts. This warrant is necessary because the Agency has been unable to obtain voluntary access to a portion of the Site owned by JKJ Realty Trust. EPA requests access to perform a removal action to address, among other things, asbestos. EPA has been working closely with the Town of Winchendon and the Commonwealth on this planned removal action. On July 29, 2019, Region 1 referred a request to DOJ for the issuance of an ex parte administrative warrant at the White Mountain Freezer (former) Site in Winchendon, Massachusetts. This warrant is necessary because the Agency has been unable to obtain voluntary access to a portion of the Site owned by JKJ Realty Trust. EPA requests access to perform a removal action to address, among other things, asbestos.
