In August 2019, Bruin E&P Partners, LLC (Bruin) and EPA signed a negotiated administrative consent agreement with Region 8. This settlement resolves Clean Air Act violations alleged by the EPA in a January 2018 Notice of Violation and self-disclosed by Bruin under and audit agreement. The settlement addresses violations of the Federal Implementation Plan and new source performance standards at oil and natural gas production operations located on the Fort Berthold Indian Reservation (Mandan, Hidatsa and Arikara Nation) (FBIR).

EPA inspectors observed emissions utilizing a forward looking infrared (FLIR) camera at storage tank systems owned by Bruin and previously owned and operated by Halc?n Resources Corporation and Halc?n Holdings, Inc. EPA issued a Notice of Violation to Halc?n Resources Corporation on January 31, 2018 and held an NOV conference with Halc?n and Bruin in March 2018.
? EPA and Bruin entered into an Audit Agreement in August 2018. Under the Agreement, Bruin audited all operations on the FBIR for compliance with the Clean Air Act and its implementing regulations.
