On September 10, 2019, Region 1 issued an Administrative Compliance Order (Order) to Duncan Galvanizing Corp. of Everett, Massachusetts for its discharges of stormwater associated with industrial activity to the Malden River without authorization of a National Pollutant Discharge Elimination System (NPDES) permit in violation of section 301(a) of the Clean Water Act. Duncan Galvanizing Corp. will be required to prepare a Stormwater Pollution Prevention Plan, apply for coverage under the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity, and submit a progress report to EPA.
