On September 4, 2019, the RJO ratified a Consent Agreement between EPA and Perdue Grain and Oilseed, LLC, the owner and operator of an edible oil refinery and storage operation in Salisbury, Maryland. The settlement requires Perdue Grain and Oilseed to pay a penalty of $22,500 and undertake a supplemental environmental project to install oil-capturing T-traps and pollution control valves in the portion of Peggy Branch that flows through the facility property to provide a redundant secondary containment in the event of a catastrophic oil spill. The SEP is estimated to cost $165,000. The settlement resolves alleged violation of CWA Section 311 and 40 CFR Part 112, which include failure to submit a facility response plan, deficiencies in the facility SPCC plan, failure to maintain records of integrity testing or provide secondary containment for several tanks and mobile storage containers. The oil enforcement program is not delegated to the state. MDE management was notified of this action.
