This is a Consent Agreement and Final Order between US EPA and Kamuela Management Commerical Property (Respondent) pursuant to Section 1423(c) of the Safe Drinking Water Act (SDWA), for Respondent's violation of the SDWA Underground Injection Control (UIC) requirements by failure to close Large Capacity Cesspools (LCC) at the Facility by April 5, 2005. Respondent agreed to comply with the applicable requirement by closing the LCC at 79-7393 Hawaii Belt Road, Kealakekua, Hawaii, and replacing it with a system that meets EPA and Hawaii Department of Health regulations. Respondent also agreed to payment of a civil penalty of $30,000 to settle the matter.
