On September 24, 2019, EPA Region III Regional Judicial Officer ratified a Consent Agreement and Final Order (CAFO) finding that WCS Construction, LLC, failed to comply with requirements of their National Pollutant Discharge Elimination System (NPDES) permit (the NPDES Permit) at the Archer Park construction site located at in Washington, DC, and owes a monetary civil penalty of $8,100 in order to promote environmental compliance and public health by deterring future CWA violations. Respondent violated the NPDES Permit by failing to: 1) properly manage ground water or accumulated stormwater prior to discharging to the District of Columbia?s (DC?s) municipal separate storm sewer system (MS4), 2) minimize chemical and fuel storage containers and solid wastes exposure to stormwater and 3) properly prepare a complete Stormwater Pollution Prevention Plan. This CAFO was subject to a public notice and comment period, which ended on September 18, 2019, during which no comments were received.
