On September 26, 2019, the Regional Judicial Officer entered a Final Order ratifying a Consent Agreement between EPA and AFCO C&S, LLC ( Respondent ), in connection with its establishment located at 800 Development Avenue, Chambersburg, Pennsylvania ( Facility ) to resolve violations alleged in a July 13, 2018 Stop Sale, Use or Removal Order ( SSURO ) issued against AFCO involving the sale and/or distribution of 10 unregistered pesticidal products, 1 misbranded pesticide, and 1 claims differ violation (i.e., claims were beyond the scope of registration of the pesticide). This enforcement case originated through a tip received by Region 3 and EPA HQ. On June 20, 2016, Region 3 performed an inspection of AFCO?s Facility. Subsequently, EPA determined AFCO was selling and/or distributing products in violation of Section 12 of FIFRA. On July 13, 2018, EPA issued AFCO a SSURO to bring AFCO into compliance with FIFRA. Th CAFO resolves 1,036 sales/distributions of documented FIFRA Section 12 violations at the time of inspection on June 20, 2016, and 105 sales/distributions of documented FIFRA Section 12 violations post-SSURO.
