Summary

On February 27, 2020, EPA filed a consent agreement and final order settling claims for civil penalties against David Bean, a residential property owner and manager, for violating TSCA by failing to comply with the Renovation, Repair and Painting Rule (RRP Rule) and by failing to disclose known lead-based paint and/or lead-based paint hazards in the course of leasing property in Keene and Hinsdale, New Hampshire. The settlement calls for implementation of a compliance plan and the payment of a $2,000 penalty based upon ability to pay. The State of New Hampshire Department of Health and Human Services was advised of this action by EPA. This settlement will help to prevent children from being exposed to lead-based paint. On September 30, 2019, Region 1 issued an Administrative Complaint (Complaint) to David Bean, owner of rental multi-unit residential properties located in and around Keene and Hinsdale, New Hampshire. Respondent also manages and conducts renovation activities at these properties. The Complaint alleges that Respondent failed to comply with the requirements of the Renovation, Repair and Painting Rule (RRP Rule) and the Disclosure Rule, promulgated pursuant to Section 402(c)(3) and 402(a) of the Residential Lead-Based Paint Hazard Reduction Act of 1992, respectively. The Complaint seeks a penalty of $127,423.
