Summary

On February 10, 2020, EPA filed a consent agreement and final order settling claims for civil penalties against ACM Group, Inc. for violations of the requirements of the Renovation, Repair and Painting (RRP) Rule, promulgated pursuant to Section 402(c)(3) of TSCA. ACM is a contractor primarily engaged in construction, renovation, restoration and demolition work. EPA alleged three violations arising out of a renovation project in Portsmouth, New Hampshire including failure to obtain initial firm certification from EPA; comply with RRP Rule work practice standards; and retain records demonstrating compliance with the RRP Rule. Following the inspection, the company came into compliance with the RRP Rule. ACM has agreed to pay a penalty of $7,203 to resolve the violations. This settlement is expected to encourage compliance in the regulated community with the Renovation, Repair and Painting Rule. The State of New Hampshire has been notified of this action. On September 30, 2019, Region 1 filed an administrative civil complaint for penalties against ACM Group, Inc. for violating regulations related to lead-based paint requirements of the TSCA Renovation, Repair and Painting (RRP) Rule.
