This is a Consent Agreement and Final Order between US EPA and Flat Creek Transportation, LLC (Respondent), for Respondent's violation of the Clean Air Act federally-approved and federally-enforceable California State Implementation Plan Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen and Other Criteria Pollutants From In-Use Heavy-Duty Diesel-Fueled Vehicles, codified at title 13, section 2025 of the
California Code of Regulations (the Truck and Bus Regulation ). Respondent agreed to pay a civil penalty of $71,250 to settle the matter.
