Region 10 Settles with White Sturgeon, LLC (Eagle, Idaho) for Clean Water Act Violations
On November 05, 2019, Region 10 filed an Expedited Settlement Agreement resolving violations of the
Clean Water Act by White Sturgeon, LLC (Respondent), located in Eagle, Idaho for their Snoqualmie
Village 1 & 2 construction site (Facility). EPA alleges that the Respondent had violations of the
Construction General Permit at its Facility. The alleged violations included; failure to include all
minimum information as required in the CGP in the Facility?s Stormwater Pollution Prevention Plan
(SWPPP) and associated site map, failure to include design specifications and installation and
maintenance details of stormwater control measures (BMPs) onsite, failure to maintain sediment trackout
controls and effectively manage off-site track-out, failure to adequately protect storm drain inlets, a
lack of temporary stabilization measures, failure to manage stockpiles, failure to design and install
adequate erosion and sediment controls/buffers, and failure to post site signage in a publicly accessible
location. Since BMPs and appropriate stormwater controls are crucial to preventing sediment, and
other pollutants, from entering the Waters of the U.S. (WOTUS), the environmental benefit of this
action is a reduction in the potential for a pollutant discharge to WOTUS. The Respondent agreed to
pay a penalty of $3,950.
