On October 15, 2019, Region 5 executed an Expedited Settlement Agreement (ESA) with BBC Construction & Remodeling, Inc. The ESA commences and concludes a proceeding identifying alleged violations o the Toxic Substance Control Act (TSCA), specifically of the Renovation, Repair and Painting Rule (RRP Rule). Region 5 alleged that in calendar year 2015, BBC Construction & Remodeling, Inc. failed to: retain all records necessary to demonstrate compliance with the RRP Rule for a period of 3 years following completion of renovation activities; obtain initial firm certification; and, obtain a written acknowledgement. BBC Construction & Remodeling, Inc. paid a $600 penalty.
