Respondent operates a waste hauling company vehicle and equipment maintenance facility located at 3 Greentown Road in Buchanan, New York. On September 13, 2019, EPA conducted an inspection of the Facility and identified that the Facility conducts industrial activity regulated under 40 C.F.R. 122.26 and discharges stormwater associated with industrial activity, to a tributary to the Hudson River via the Village of Buchanan storm sewer system and outfall. At the time of the inspection, the Facility did not have coverage under a SPDES Permit. This Order serves to require the Facility to obtain SPDES permit coverage for the unpermitted stormwater discharges associated with the industrial operations.
