The U.S. Environmental Protection Agency, Region IX ( EPA ), pursuant to its authority under Section 309(a) of the Clean Water Act ( CWA ), 33 U.S.C. 1319(a), has fully executed the Administrative Order on Consent ( Order ) related to the dredge and fill activities performed in the Waialua Stream in Kaunakakai, Hawaii, without authorization under Section 404 of the CWA, 33 U.S.C.1342. Within 30 days of the enclosed Order's effective date a draft restoration plan 0.25 acres of wetland shall be submitted to EPA for its approval.
