On March 9, 2020, Region 10 filed a consent agreement and final order resolving violations of the
Clean Water Act by Americold Logistics, LLC - Lynden, Lynden, Washington. Respondent, which
warehouses perishable gooods, discharged pollutants to waters of the U.S. and was found to be
operating in violation of the Washington State Industrial Stormwater General Permit. Violations include
failure to implement corretive action after benchmark exceedances, failure to document monthly
inspections, failure to monitor, and inadequate stormwater pollution prevention plan. The company is
now operating in compliance and doing so will reduce the amount of stormwater discharges into
fishtrap Creek which flows to the Nooksackt River which flows to the Puget Sound. These are
anadromous fish passage waters. The company agreed to pay a penalty of $41,500.
