Summary

Respondent failed to maintain each opening in the internal floating roof at Tank 81 in a closed position at all times (except when the device is in actual use), in violation of 40 C.F.R. 60.112b(a)(1)(iv) of the NSPS Subpart Kb regulation; failed to ensure that the concentration of organic vapor in the vapor space above the internal floating roof at Tank 81 does not exceed 30 percent of its lower explosive limit, in violation of N.J.A.C. 7:27-16.2(l)(7)(vi) of the New Jersey SIP; failed to adequately conduct required monthly leak inspections of all equipment in gasoline service at the gasoline loading rack, in violation of 40 C.F.R. 63.424(a) and (b), 60.5020), and 60.505(c) of the Bulk Gasoline Terminals MACT and the Bulk Gasoline Terminals NSPS regulations; failed to conduct annual Method 21 monitoring for ductwork, piping and connections to vapor collection systems and control devices at the marine loading dock, in violation of 40 C.F.R. 63.563(c) of the Marine Loading MACT Subpart Y regulation; failed to report the above violations in its annual Title V permit compliance certification for calendar years 2016 and 2017. Injunctive relief includes: Tank 81 must be connected to a closed vent system and control device (a vapor combustion unit) designed and operated to reduce inlet VOC emissions by at least 98 percent by weight.
