) On December 6, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement negotiated pursuant to Section 9006 of RCRA to settle violations of RCRA Subtitle I, and Pennsylvania?s federally-authorized underground storage tank (UST) program, by Jai Radhey Corp. Respondent is the operator of three USTs located at Fuel On 1, a fueling facility, located in Luzerne, Pennsylvania. As a result of this case Region 3?s enforcement team, in coordination with the Pennsylvania Department of the Environmental Protection, was able to resolve the UST violations of failing to conduct annual functionality testing of the line leak detectors installed on the pressurized piping, as well as failing to conduct piping release detection. The violations were discovered through information collected during an inspection at the facility by the RCRA Section on April 12, 2018. Jai Radhey Corp is responsible for a $1,880 penalty and has returned to compliance with the violations.
