On January 16, 2020, Region 10 filed an ESA against BSD Investments, Inc. located in Ephrata, Washington, to address violations of Section 312 of the Emergency Planning and Community Right-to-Know Act for failing to file the annual Tier II Hazardous Chemical Inventory Report for calendar year 2018. The facilities qualified for an ESA instead of the traditional enforcement action because the facilities store fuels under 30 times the reporting threshold. The ESA was for $5,000.
