On January 9, 2020, EPA Region 6 issued a Consent Agreement and Final Order to Gerber Products Company, resolving three violations of Section 313 of the Emergency Planning & Community Right-To-Know Act (EPCRA) for its facility in Fort Smith, Arkansas. An EPA audit revealed that the facility failed to report its treatment of nitrate compounds in waste for the 2015, 2016, and 2017 calendar years. Gerber Products has corrected the violations and has agreed to pay a civil penalty of $24,450.00.
