On January 6,2020, EPA Region III filed a signed CAFO resolving alleged violations of the CWA by K. Hovnanian Virginia Old GC, Inc. (formerly known as K. Hovnanian Homes of Virginia, Inc.). EPA alleged that the respondent violated the applicable construction stormwater permit at the Eagles Pointe site located in Woodbridge, Virginia. The alleged violations consisted primarily of failing to properly maintain and/or install best management practices required by the facility's stormwater pollution prevention plan and the CWA permit. Virginia DEQ representatives accompanied EPA in the inspection that led to this action. EPA notified Virginia DEQ of its actions. The Respondent will pay $45,000 in penalties under the CAFO.
