On January 10, 2020, Region 1 filed a consent agreement and final order (CAFO) resolving TSCA violations at the Bath Iron Works Corporation (BIW) facility located in Brunswick, Maine. The CAFO alleges that BIW violated notice and manifesting regulations for PCB waste that BIW disposed of at a landfill that was not authorized to accept waste containing PCBs in concentrations greater than or equal to 50 parts per million. The Region learned of the TSCA violations when BIW's consultant submitted a Self-Implementing Cleanup Plan for PCBs for BIW's facility. BIW acted promptly to remedy the violations and bring its facility into compliance. The company has agreed to pay a $22,479 penalty to resolve this matter and certifies that it is now operating in compliance with TSCA. The Region has coordinated with the State of Maine in this action. The State is not authorized to enforce the PCB regulations but supports the action.
