Defendant is a private corporation engaged in the manufacturing of asphalt plant mix and asphalt paving in Puerto Rico. EPA is requesting that DOJ file a claim against the Defendant for past and future response costs under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA), 42 U.S.C. 9601-9675, with respect to the PROTECO Superfund Site located in Pe?uelas, Puerto Rico.
On May 15, 2023, the federal district court for the District of Puerto Rico granted a motion to approve a bankruptcy settlement agreement.
