The AOC, entered into on December 15, 2019, requires the City to: (1) Complete six (6) high priority combined sewer overflow (CSO) projects by the dates identified in the AOC, with all 6 of the CSO projects being completed by December 31, 2025. These CSO projects are expected to cost approximately $35.7 million. (2) Report annually on the non-CSO work that New Bedford has committed to implement over the term of the Order, which is necessary to justify the CSO schedule in the Order and the affordability analysis that supports the CSO schedule. The non-CSO work under the AOC is expected to cost approximately $43 million. The total estimated injunctive relief under the Order is $78.7 million. (3) Complete illicit discharge detection and elimination (?IDDE?) investigations of sub-catchment areas discharging from three (3) CSO outfalls and three (3) MS4 outfalls in accordance with the dates specified in the Order. All of the IDDE investigations must be completed by September 30, 2021. The City must also complete dry-weather screening of another CSO outfall by September 30, 2020. (4) Submit a CSO monitoring plan for EPA approval by December 31, 2019. (5) Submit annual compliance reports that include the information required under the Order.
