On January 30, 2020, EPA Region 1 issued a Final Order settling a case against Dave Johnson Building and Remodeling, Inc.of South Portland, Maine for its failure to comply with the requirements of the Renovation, Repair and Painting Rule, promulgated pursuant to Section 402(c)(3) of the Residential Lead-Based Paint Hazard Reduction Act of 1992. Specifically, the company violated the RRP Rule?s certification/training, disclosure, and work practices requirements. The Final Order acknowledges receipt of a penalty payment of $1,706 for the four alleged violations pertaining to a single-family home window replacement project performed in 2018 in South Portland, Maine. This enforcement action is expected to encourage compliance in the regulated community with the Renovation, Repair and Painting Rule and help protect residents from exposure to lead-based paint. Enforcement of the RRP Rule is not delegated to the State of Maine.
