This Administrative Settlement Agreement and Order on Consent (Settlement)
is entered into voluntarily by the United States Environmental Protection Agency (EPA) and the
Union Pacific Railroad Company (Respondent). This Settlement provides for the performance of
100% Remedial Design (RD) of the River Mile 10 East (RM 10E) Project Area and the payment
by Respondent of certain response costs incurred by the EPA, the Oregon Department of
Environmental Quality (ODEQ), and the Tribal Governments at or in connection with the Work
conducted under this Settlement, related to the selected remedy for the in-river portion of the
Portland Harbor Superfund Site (the Site).
