a Consent Agreement and Final Order entered into by the U.S. Environmental Protection Agency, Region III ( EPA ) and Good Business Services II LLC ( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Resource Conservation and Recovery Act ( RCRA ). The alleged violations, discovered as a result of a July 12, 2017 inspection conducted by or on behalf of the Pennsylvania Department of Environmental Protection ( PADEP ) at Respondent's UniMart 4345 facility located at 3197 Route 115 in Effort, Pennsylvania, involved the failure to investigate an indication of a release of a regulated substances in connection with petroleum underground storage tank ( UST ) systems at the facility. It is a fundamental goal of RCRA and implementing UST regulations to limit harm from USTs that release regulated substances. Though no release was documented, Respondent's failure to promptly investigate upon indications that a release of a regulated substance may be occurring for an extended period of time increased the risk would cause harm to human health or the environment. According to the CAFO, Respondent is assessed a penalty in the amount of two thousand eight hundred dollars ($2,800) for its role as operator in the alleged violations.
