On February 26, 2020, Region 1 issued an Administrative Compliance Order (Order) requiring Scituate Concrete Products Corp. of Scituate, Massachusetts to address discharges of stormwater associated with industrial activity to Herring Brook without authorization of a National Pollutant Discharge Elimination System (NPDES) permit in violation of section 301(a) of the Clean Water Act. Scituate Concrete Products Corp. will perform site improvements to infiltrate stormwater on-site, thereby eliminating its stormwater discharges. The NPDES program has not been delegated to Massachusetts, but the Massachusetts Department of Environmental Protection supports issuance of this Order.
