On February 3, 2020, Region 5 executed an Expedited Settlement Agreement (ESA) with North American Warehousing Company (NAWC). The ESA commences and concludes an administrative proceeding against NAWC, identifying alleged violations of the Resource Conservation and Recovery Act (RCRA).
NAWC owns and operates a 400,000 square-foot warehouse operation located in Bedford Park, Illinois, and has approximately 25 employees. The facility's operations include chemical logistics and distribution. The ESA alleges NAWC failed to file a notification regarding changes in the types and amounts of hazardous waste handled at the facility (including the facility's change in status to Large Quantity Generator) and failed to complete annual reporting regarding hazardous waste shipments from the facility. The ESA requires NAWC to pay a civil penalty of $3,500. NAWC filed the required notification regarding its generator status and has filed an annual report regarding hazardous waste shipments prior to the filing of the ESA.
