The Environmental Protection Agency Region 9 finalized a settlement agreement with New Bern Transport (PepsiCo subsidiaries) for violations of California's regulation (incorporated into a federally enforceable State Implementation Plan) to reduce emissions of diesel particulate matter, oxides of nitrogen and other criteria pollutants, from in-use heavy-duty diesel-fueled vehicles, known as California's Truck and Bus Rule. The PepsiCo subsidiaries failed to verify 104 fleets. Respondent agrees to pay the civil penalty of $24,375.
