On March 5th, 2020, EPA Region 6 issued a consent agreement and final order CAFO under its authority pursuant to RCRA to Fairbanks Morse, LLC. located at 12253 FM 529 Rd, Houston, TX. The CAFO was issued in response to violations of:1) Failure to file initial 3010
2) Failure to file biennial Report, 3) Failure to make proper hazardous waste determination and 4) Failure meet the requirement of a declared generator status The CAFO requires Fairbanks Morse to:
a. certify that it has assessed all of its solid waste streams at the Fairbank Morse Facility to determine the accurate waste codes and has developed and implemented standard operating procedures ( SOPs ) to ensure that Respondent is operating the Fairbank Morse Facility in compliance with RCRA and the regulations promulgated thereunder, including, but not limited to, procedures for: (a) making hazardous waste determinations; (b) managing hazardous wastes; (c) reporting, transporting, and disposing of hazardous waste; (d) preparing its manifests; and (e) meeting the requirements of the land disposal restrictions.
b. Certify that it has accurately and adequately complied with the RCRA Section 3010 notification requirements for the Fairbank Morse Facility.
c. Provide, with its certification, a copy of Respondent's SOPs as described in subparagraph a above.
d. Provide the cost of implementing the requirements.
e. Provide the average amount (pounds) of hazardous waste that is properly managed per year at
