Region 10 Settles with Zenith Energy Terminals (Portland, OR) for CWA Violations
On July 13, 2020, Region 10 filed an Expedited Settlement Agreement (ESA) resolving violations of the
Clean Water Act by Zenith Energy Terminals located in Portland, Oregon. The terminal receives,
stores, and delivers heavy and light petroleum products via vessels, railroad and truck loading rack. An
EPA Spill Prevention, Control and Countermeasure (SPCC) inspection and SPCC plan review
determined the SPCC plan and facility implementation of the SPCC plan lacked adequate spill
prevention precautionary measures. As part of the ESA, the company spent approximately $400,000
updating the SPCC plan and resolving the violations found at the time of inspection. The SPCC
program is centered around the prevention of oil spills and, for a facility such as Zenith Energy that has
an oil storage capacity of over 72 million gallons, the injunctive relief measures Zenith implemented for
this ESA will help to prevent future releases from its facility. The company also agreed to pay a penalty
of $5,850 for the SPCC violations.
