On March 31, 2020, after a 30 day public comment period, Region III issued an Administrative Order for Compliance (AO) to Resources Preservation, Inc. (f/k/a ARG Resources, Inc.) addressing noncompliance at wells at its facility, located in the Allegheny National Forest, including: (1) 227 wells, which must either be plugged and abandoned, demonstrate mechanical integrity, or demonstrate non-endangerment of underground sources of drinking water; and (2) 48 improperly plugged wells requiring corrective action, which must be re-entered and properly plugged and abandoned according to UIC regulation and permit requirements. The AO supersedes a 2018 AO and requires that Resources Preservation submit for EPA approval within 30 days of the effective date a plan for returning the 275 wells to compliance. EPA administers the UIC program in the Commonwealth of Pennsylvania and has communicated with PADEP regarding the proposed AO.
