On May 28, 2020, EPA Region 10 settled with CH2O, Inc. (Tumwater, WA) for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). During a May 29, 2018 inspection of the companys pesticide-producing establishment, EPA found that CH20 was distributing a misbranded pesticide called PACT-5 in violation of FIFRA Section 12(a)(1)(E). The misbranded PACT-5 label displayed the incorrect signal word CAUTION instead of DANGER, omitted two full paragraphs of precautionary statements focused on user safety, and displayed an incorrect reactivity rating of 0 instead of 1. The company agreed to pay a civil penalty of $92,900.
