Respondent violated the requirements of its National Pollutant Discharge Elimination System permit (Permit #KSR111937), in violation of Section 402 of the Clean Water Act, 33 U.S.C. ? 1342. The EPA alleges that Respondent failed to adequately implement best management practices to limit sediment runoff. Violations of the Respondent?s NPDES permit include failure to properly design, install, implement, and/or maintain pollution prevention measures, failure to fully implement the provisions of the SWPPP, failure to include required elements in its SWPPP, and failure to fully inspect all areas of the site.
