On June 8, EPA Region 10 ratified a Consent Agreement and Final Order under Section 113 of the Clean Air Act to J.K. Merrill & Sons, Inc., of Pocatello, Idaho resolving violations of 40 C.F.R. Part 63, Subpart ZZZZ at the companys Pocatello, Idaho, sand and gravel plant. The respondent previously entered into a compliance order on consent. The respondent agreed to a civil penalty of $123k.
