On May 4, 2020 the Regional Judicial Officer approved an expedited settlement agreement with Scituate Concrete Products Corp. of Scituate, Massachusetts resolving violations of Section 301 of the Clean Water Act. On July 2, 2019, EPA conducted an inspection of the facility and found that Scituate Concrete Products Corp. was discharging stormwater from the northern drainage area of the facility into the Municipal Separate Storm Sewer System for the Town of Scituate (the Town's MS4). These discharges were not authorized by an individual NPDES permit nor the NPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). The settlement requires that the company pay a $40,000 penalty. The Region had previously issued an administrative order to the company in February 2020 requiring that the company come into compliance with the Clean Water Act. The Region worked in coordination with the Massachusetts Department of Environmental Protection on this case.
