On August 4, 2020, Region 10 filed a Consent Agreement and Final Order (CAFO) to address
violations of the Clean Water Act by Northern Alaska Contractors LLC, located at 300 Overland Drive,
Unalaska, Alaska. Respondent, which operates the Ugadaga Quarry, had numerous violations of the
CWA and its National Pollutant Discharge Elimination System (NPDES) permit. The violations
include failure to conduct required monitoring, sampling, and reporting; failure to minimize pollutant
exposure to stormwater; failure to update the Stormwater Pollution Prevention Plan (SWPPP); failure
to provide secondary containment; and failure to properly store, handle, and dispose of construction
waste. The Respondent agreed to pay a penalty of $62,500. The Environmental Benefits of this
enforcement action will be a reduction in the potential for pollutants to enter waters of the U.S. by
requiring the site to properly sample and monitor stormwater.
