This Consent Agreement and Final Order ( CAFO ) is issued under the authority vested in the Administrator of the U.S. Environmental Protection Agency ( EPA ) by sections 311(b)(6)(A) and (B)(i) of the Clean Water Act ( CWA or Act ), 22 U.S.C. Sections 1321 (b)(6)(A) and (B)(i), as amended by the Oil Pollution Act of 1990, and under the authority provided in 40 C.F.R. Sections 22.13 and 22.18(b)(2). Complianant, EPA Region IX, initiated this proceeding against USS POSCO Industries ( UPI or Respondent ) for alleged violations of Sections 311(j) or the Act, 33 U.S.C. Section 1321(j) and its implementing regulations, at Respondent's facility located at Pittsburg, California (the Facility ). Respondent certifies by signing this CAFO that, to the best of its knowledge, as of the Effective Date of this CAFO, it is in compliance with the requirements of Section 311(j) of the Act, 33 U.S.C. Section 1321(j) at the Facility.
