EPA filed an administrative consent agreement and final order on June 12, 2020 settling its case against Barden's Boat Yard, Inc., for violations of the 2015 NPDES Stormwater Multi-Sector General Permit for Industrial Activities (MSGP) at its Marion, MA boat storage and repair yard. Under the agreement, the company agrees to pay a $32,000 penalty. EPA previously issued an administrative compliance order requiring the company to correct the noncompliance and submit a progress report to EPA within one year of the issuance of the order. As a result of an inspection, EPA had found that the company had failed to conduct certain monitoring and prepare all the records required by the MSGP. In addition, the company was discharging process wastewater to the stormwater system, an unauthorized discharge under the MSGP.
