Summary

On June 16, 2020, the Regional Judicial Officer for EPA-Region III issued a Final Order concluding a proceeding initiated by EPA under the federal Clean Air Act (CAA) against Superior Concrete Materials, Inc. (Superior) for violation, over multiple years, of the requirement for an operating permit, and of a federal hazardous air pollutant emission standard applicable to stationary reciprocating internal combustion engines, at Superior's former ready-mix concrete batch plant in Washington, D.C. Superior violated the District of Columbia State Implementation Plan requirement for an operating permit, and applicable management practices, and operation and maintenance, monitoring, compliance demonstration, and recordkeeping requirements, of the emission standard to control emissions of the hazardous air pollutant formaldehyde from a compression ignition stationary reciprocating internal combustion engine. The Final Order, which incorporates a Consent Agreement executed by the parties, resolves the alleged past civil violations. The proceeding was initiated by a proposed consent agreement and final order, and associated penalty calculation, transmitted by EPA to Superior as part of a pre-filing settlement opportunity. Under the terms of the settlement, a civil penalty of $250,000 will be paid by Superior. The District of Columbia Department of Energy and Environment had asked EPA-Region III to address this facility.
