Nikkei MC Aluminum America Inc. (Nikkei), located in Columbus, Indiana was issued a Finding of Violation (FOV) on June 16, 2016 alleging violations of the Clean Air Act. The FOV alleges violations of National Emission Standards for Hazardous Air Pollutants (NESHAP) for Secondary Aluminum Production at 40 C.F.R. Part 63, Subpart RRR. Specifically, the company violated the NESHAP by failing to design an exhaust system at Furnaces A, B and C that achieve the requirements of Subpart RRR through the American Conference of Industrial Hygienists, and by falling below the 3-hour block average operating temperatures of the afterburners for Chip Dryer #1 and #2. EPA discovered these violations through an inspection of the facility on September 4, 2013 and a subsequent information request, sent on June 19, 2014. The final settlement has been delayed because of injunctive relief construction, and EPA observation needed to ensure compliance. The ACO requires Nikkei to amend the standard of procedure during furnace operation to minimize emissions and submit an amended operations and maintenance plan with the Indiana Department of Environmental Management. By making these changes Nikkei will ensure the reduction of fugitive emissions during furnace operations.
