Region 10 Settles with Aspen Homes and Development LLC for CWA Violations (Coeur d'Alene, ID)
On 9/28/2020, EPA Region 10 filed an expedited settlement agreement resolving violations of the
Construction General Permit by the Aspen Homes and Development LLC (?Respondent?), located in
Coeur d'Alene, Idaho. Respondent is the owner and operator of the Riverview Heights construction site
and failed to conduct and document over 25 inspections, failed to update and maintain Stormwater
Pollution Prevention Plan (SWPPP) records, and failed to install and maintain Best Management
Practices (BMPs) such as erosion and sediment control measures, which resulted in turbid runoff from
the property. Since erosion leads to sediment and other pollutants entering Waters of the United States,
EPA estimates that this action has helped reduce 171,112 lbs of sediment from discharging off-site and
reaching the Spokane River. The injunctive relief is estimated to be $3,362 and the Respondent has also
agreed to pay a penalty of $20,325.
