Between August and October 2014, Garrett Construction Company, Inc., discharged fill material into Palmer
Lake on two properties in Loomis, Okanogan County, Washington. Garrett Construction Company, Inc., used a
cat excavator and other heavy equipment to build retaining walls at each property below the ordinary highwater
mark of Palmer Lake without a CWA Section 404 permit from the U.S. Army Corps of Engineers. Before
EPA's enforcement, restoration at both properties took place, through enforcement actions initiated by the
Washington Department of Ecology against the property owners. Garrett loaned equipment to remove one of
the retaining walls during the restoration. This agreement resolves alleged violations with Garrett through a
civil penalty in the amount of $15,995.00.
