Region 5 Files RCRA Consent Agreement and Final Order With Bemis Wisconsin, LLC, New London, Wisconsin.
On July 9, 2020, Region 5 filed a Consent Agreement and Final Order commencing and concluding a proceeding with Bemis Wisconsin, LLC (Bemis) resolving violations of the large quantity generator standards under the Wis. Admin. Code ? NR 662.034(1)-(3). Bemis has corrected these violations and agrees to pay a civil penalty of $41,335. Bemis manufactures packaging for food products, and operates as a large quantity generator of hazardous waste, including residual waste ink. EPA identified the violations as a result of a compliance evaluation inspection conducted at Bemis? facility on June 7, 2017. EPA alleges that, for a time period which included 2015 to 2017, Bemis failed to conduct required daily hazardous waste tank inspections and have adequate secondary containment for this tank; failed to meet certain satellite accumulation area requirements, including failing to properly label a certain 55 gallon drum; failed to label used oil containers; failed to have complete training records; failed to have a complete contingency plan; failed to implement and document a complete Subpart BB LDAR program; and failed to conduct and document an annual Subpart CC inspection on the hazardous waste tank. On October 31, 2017, EPA sent Bemis a Notice of Violation identifying these violations.
